Tally: Terms of Use

Last updated 5 November 2026.

These terms are the agreement between you and Setout Labs LLC, a Delaware limited liability company ("we"), for the iPhone and Android app Tally. By using the app you accept them. If you do not accept them, do not use the app. You must be at least 13 years old, or the minimum age where you live to consent to online services, to use the app. If you got the app from the App Store, it is licensed to you under Apple's standard Licensed Application End User License Agreement; these terms add to it.

What Tally is

Tally counts days in the Schengen Area under the 90-days-in-any-180 rule, from the trips you enter. It is a planning aid, not legal or immigration advice, and not an official calculation. Its results are only as accurate as the dates you enter.

Border authorities decide how long you may stay. Their count, your visa, a residence permit, a bilateral agreement or national rules can differ from Tally's. Check with the relevant authority before you travel, and do not rely on Tally alone to decide whether you may enter or stay. We are not liable for refused entry, fines, bans or other consequences of an overstay.

Free features and Tally Planning

The day counter, trips (including planned trips), the leave-by and come-back dates, the count for every date on the calendar, How this is counted, and trip checks never need Tally Planning. Trip checks include the warning when a stay puts a later saved trip over the limit and, when no saved trip comes after the stay, a shorter stay or later entry date that fits. Tally Planning adds the longest stay that keeps every saved trip within the limit, from a checked entry date or any future date on the calendar, and shorter-stay or later-entry suggestions checked against your saved trips. The yearly plan can start with a 1-week free trial if you are eligible. You are charged when the trial ends unless you cancel before then: on iPhone at least 24 hours before it ends, on Android before it ends.

Tally Planning is sold through the App Store and Google Play as a yearly subscription, or a one-time lifetime purchase. The price is shown in the app and by Apple or Google before you confirm.

  • Yearly subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple ID or Google account is charged for the renewal.
  • To manage or cancel a subscription on iPhone, open the Settings app, tap your name, then Subscriptions. On Android, open the Google Play app, tap your profile picture, then Payments & subscriptions → Subscriptions. Deleting the app does not cancel it.
  • The lifetime option is a single payment and does not renew.
  • Payments and refunds are handled by Apple or Google under their policies. Request a refund from Apple at reportaproblem.apple.com, or for a Google Play purchase from Google in your Google Play order history.
  • If you reinstall the app or get a new phone, sign in with the same Apple ID or Google account and tap Restore purchases in Settings, or Restore on the Tally Planning screen.

Acceptable use

Do not use the app to break the law or infringe anyone's rights, reverse engineer it, or get around its technical limits or security.

Our content

The app and its software, design and branding belong to Setout Labs LLC or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it as intended. Nothing else is granted.

Availability and changes

We may change, suspend or discontinue any part of the app, and we may update these terms. For material changes we will give reasonable notice. Continuing to use the app after a change means you accept it.

Disclaimer and liability

The app is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We do not promise it will be uninterrupted, error-free or free of data loss. We are not liable for indirect, incidental or consequential loss, or for lost data. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid for the app in the 12 months before the event giving rise to the claim, or USD $50. Nothing here limits liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot lawfully be limited. Some places do not allow these exclusions, so parts may not apply to you.

Apple and Google

Apple and Google are not parties to these terms and are not responsible for the app or its support. If you got the app from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory law in your country of residence requires otherwise. Disputes will be resolved exclusively in the state and federal courts located in Delaware, except where the law gives you the right to bring a claim in your local courts. Nothing here limits consumer-protection rights that cannot be waived by contract.

General

If a provision is unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not assign these terms; we may assign them to a successor of our business.
